For the reasons discussed during the hearing, the motion #157 is granted. In sum, Rule 6(b)'s extension provision does apply to Rule 25(a), Continental Bank v. Meyer, 10 F.3d 1293, 1297 (7th Cir. 1993), and indeed extensions should be liberally granted in that context, see id. Also, the Court can alleviate prejudice by extending the time to retain an expert (if the defense so chooses). What's more, pro bono recruited counsel are often (as here) asked to represent an indigent client in an area of the law where counsel encounters new issues, like the death of a party. That factor too weighs as an equitable consideration (at bottom, excusable neglect is an equitable standard) in Plaintiff's favor. As discussed during the hearing, the response #159 filed by Defendant Brooks to the motion to substitute is deemed to be the response by Ghaliah Obaisi, Independent Executor of the Estate of Dr. Saleh Obaisi, for Defendant Saleh Obaisi. But if necessary, Ms. Obaisi may file a supplemental response by 07/25/2018. Absent a supplemental response, the motion to substitute will be granted. Attorney Miguel E. Larios reported that he will accept service (via the email address in the Suggestion) of the motion to substitute on behalf of Ghaliah Obaisi. But counsel has not received those documents. Plaintiff's counsel reportedly sent out another set of settlement documents for signature. Plaintiff's counsel requested that the status hearing currently set for tomorrow, 6/19/18, for a report on the parties' efforts to finalize their settlement be moved out for another 30 days. Plaintiff's counsel reports that the IDOC Defendants have no objection to moving tomorrow's status hearing. Tomorrow's status hearing was set on 5/2/18 #146 when the parties' asked the Court to strike the status hearing then set for 5/3/18 because the parties had resolved the few lingering issues that had prevented the parties from fully closing the settlement they announced they had reached in principle on 4/24/18 #145 .. The parties asked for a 45 day extension at that time believing that a stipulation to dismiss would be filed within that time period. In light of all of this, the Court will strike the status hearing set for 6/19/18 and terminate the referral in this case. Plaintiff has settled with the IDOC Defendants and the Wexford Defendants are not interested in settlement #133 . Instead, they will be briefing summary judgment. Plaintiff and the IDOC Defendants should be able to exchange signed settlement documents without the Court's assistance. Plaintiff has withdrawn the motion concerning the communications interrogatory (Interrogatory 7, and its associated Document Request 7). With regard to IDOC policies responsive to Document Requests 2-6, Brooks shall confirm to defense counsel, who in turn shall supplement the response to those Requests, that he does not possess a personal copy of any responsive policy. In this context, "personal" means a copy of a responsive IDOC policy that he has in his assigned office, desk, or computer folder. If the confirmation is obtained, and the supplement served, then Brooks need not provide any more documents in response to the Requests. The supplement is due by 01/19/2017. With regard to Obaisi, if Obaisi has a set of responsive IDOC policies in his assigned office, see Ann Hundley Davis Dep. at 54:22-55:2, then he must provide responsive IDOC policies by 01/19/2017, unless IDOC itself asserts some sort of confidentiality protection or privilege (which would be unexpected in this context). If Obaisi does not have the IDOC policies in his assigned office (or if he did, but no longer does), then he shall so state in a supplement to the response to Requests 2-6, also due by 01/19/2017. In any event, Plaintiff may immediately subpoena IDOC directly for IDOC policies. Hardy, 13 C 4697. With regard to Walker's employment history, IDOC counsel shall determine whether the ARB can electronically search for grievances by accused-employee name. If yes, then grievances against Walker alleging a refusal to key out an inmate for a medical appointment shall be disclosed to Plaintiff by 09/12/2016. Additionally, IDOC counsel shall check Walker's personnel file for any such accusations or disciplinary history, and inform Plaintiff of the result by 09/12/2016 (and disclose documents by that date, if any). With regard to Mitchell, the defense shall disclose, by 09/12/2016, documents in her personnel file that show her dental-care education, experience, qualifications, and training. Any requests for a Rule 37 conferral or for a response to a discovery question must be responded to with seven days, if even to say that more time is needed to consider the request. For the reasons stated in the Order, the motion for leave to proceed in forma pauperis #3 is granted and the motion for attorney representation #4 is granted. As in Case No. 14 C 06211 filed by Crawford, the Court recruits again David Michael Friebus of Baker & Hostetler LLP, 191 North Wacker Drive, Suite 3100, Chicago, IL 60601. Crawford is assessed an initial partial filing fee of $8.26. The trust fund officer at Crawford's place of incarceration is authorized and ordered to collect the partial filing fee from Crawford's trust fund account and pay it directly to the Clerk of Court. After payment of the initial partial filing fee, Crawford's trust fund officer is directed to collect monthly payments from Crawford's trust fund account in an amount equal to 20% of the preceding month's income credited to the account. Monthly payments shall be forwarded to the Clerk of Court each time the amount in the account exceeds $10 until the full $350 filing fee is paid. All payments shall be sent to the Clerk, United States District Court, 219 S. Dearborn St., Chicago, Illinois 60604, attn: Cashier's Desk, 20th Floor, and shall clearly identify Crawford's name and this case number. This payment obligation will follow Crawford wherever he may be transferred. On screening review, the complaint survives except for Defendant Officer Alvarez, who is misjoined and is dismissed from this case.
