For the reasons discussed during the hearing, the motion #157 is granted. In sum, Rule 6(b)'s extension provision does apply to Rule 25(a), Continental Bank v. Meyer, 10 F.3d 1293, 1297 (7th Cir. 1993), and indeed extensions should be liberally granted in that context, see id. Also, the Court can alleviate prejudice by extending the time to retain an expert (if the defense so chooses). What's more, pro bono recruited counsel are often (as here) asked to represent an indigent client in an area of the law where counsel encounters new issues, like the death of a party. That factor too weighs as an equitable consideration (at bottom, excusable neglect is an equitable standard) in Plaintiff's favor. As discussed during the hearing, the response #159 filed by Defendant Brooks to the motion to substitute is deemed to be the response by Ghaliah Obaisi, Independent Executor of the Estate of Dr. Saleh Obaisi, for Defendant Saleh Obaisi. But if necessary, Ms. Obaisi may file a supplemental response by 07/25/2018. Absent a supplemental response, the motion to substitute will be granted. Attorney Miguel E. Larios reported that he will accept service (via the email address in the Suggestion) of the motion to substitute on behalf of Ghaliah Obaisi. June 18, 2018 Filing 150 MINUTE entry before the Honorable Jeffrey T. Gilbert: Plaintiff's counsel called chambers today and reported that Plaintiff signed the settlement papers with the IDOC Defendants, and mailed them back to counsel 3 weeks ago. But counsel has not received those documents. Plaintiff's counsel reportedly sent out another set of settlement documents for signature. Plaintiff's counsel requested that the status hearing currently set for tomorrow, 6/19/18, for a report on the parties' efforts to finalize their settlement be moved out for another 30 days. Plaintiff's counsel reports that the IDOC Defendants have no objection to moving tomorrow's status hearing. Tomorrow's status hearing was set on 5/2/18 #146 when the parties' asked the Court to strike the status hearing then set for 5/3/18 because the parties had resolved the few lingering issues that had prevented the parties from fully closing the settlement they announced they had reached in principle on 4/24/18 #145 .. The parties asked for a 45 day extension at that time believing that a stipulation to dismiss would be filed within that time period. In light of all of this, the Court will strike the status hearing set for 6/19/18 and terminate the referral in this case. Plaintiff has settled with the IDOC Defendants and the Wexford Defendants are not interested in settlement #133 . Instead, they will be briefing summary judgment. Plaintiff and the IDOC Defendants should be able to exchange signed settlement documents without the Court's assistance.
