One of the terms of the agreement is that the parties will execute a written settlement agreement containing the material terms articulated on the record today. However, they have agreed that contract formation occurred today, that there is a binding settlement agreement today and that the ultimate execution of the contemplated written agreement is not a precondition to contract formation. See Loop Paper Recycling, Inc. v. JC Horizon Ltd,. 2010 WL 1655254 (N.D.Ill.2010); Todd, Jr. v. Kohl's Dept. Store, 2010 WL 3720265 (N.D.Ill. 2010). The court wishes to express its thanks and appreciation to Michael Wilder, James Witz and Abiman Rajadurai of Littler Mendelson counsel for the plaintiff, and Amber Welock of Welock Law, counsel for defendant, and to their clients for the cooperative spirit in which they approached this case and participated in the settlement process. They conducted themselves admirably and approached the conference in the cooperative spirit that unfortunately too few lawyers exhibit in today's contentious climate. Without the conspicuous skill and patience they brought to their tasks, the case would not have had the successful outcome that it did. Their conduct is proof that lawyers can act civilly and courteously in their dealings with opposing counsel without sacrificing in the slightest the obligations they owe to their clients. The parties have consented to jurisdiction here. All matters relating to the referral of this case having been completed, the referral is closed, and the case is returned to Judge Guzman.
