MEMORANDUM Opinion and Order: For the foregoing reasons, the Siprut Defendants' motion to compel arbitration 37 , is granted, and the case is stayed pending arbitration. Additionally, the Siprut Defendants' motion to strike 56 , is deni ed. The Siprut Defendants' request for fees and costs is denied because Short's argument in opposition to the motion to compel arbitration is not frivolous. Respondent Slater's motion to quash subpoena 48 is denied without prejudice. The 12/12/2016 status date is vacated. The Court will rule by mail on the pending motions to dismiss, 40 42 .
