Filing 33 MEMORANDUM Opinion and Order: This matter comes before the Court on Defendants Donald Borowski, Kevin Gorman, Wayne Hameister, Richard Lindeman, Donald Olivieri, Jr., and David Zeglis' (collectively, "Defendants") motion to dismiss Plaintiff Federal Deposit Insurance Corporation as Receiver for First United Bank's (the "FDIC") complaint filed on June 15, 2016 (the "Complaint") pursuant to Federal Rules of Civil Procedure 12(b)(6) and 10(b).
