Filing 19 MEMORANDUM Order: On July 21, 2017 this Court issued a memorandum order ("Order") that reserved judgment on the motion of attorney Thomas Lupo ("Lupo") to withdraw as the designated counsel for prisoner plaintiff Calvin Wiggins ("Wiggins"). That reservation of judgment made it plain that Lupo was to consider the matter in the terms called for in the Order. More than two weeks has since elapsed, with nothing having been said by Lupo in response. That is more than enough time for a knowledgeable lawyer to have weighed in on the subject. Accordingly Lupo's motion is denied. Signed by the Honorable Milton I. Shadur on 8/10/2017:Mailed notice(clw, ) |
Filing 17 MEMORANDUM Order: For the reasons stated in this memorandum order, attorney Lupo must in the first instance determine what authorities support his position as to handling Wiggins' claim in this case, unless of course the situation is one callin g for Lupo's filing of the civil equivalent of an Anders brief. And that means Lupo must confer with his client, Wiggins, sufficiently to evaluate Wiggins' claim on the merits. Hence this Court reserves judgment on Lupo's motion to withdraw pending his exposition of the matter in the terms called for here. Signed by the Honorable Milton I. Shadur on 7/21/2017:Mailed notice(clw, ) |
Filing 11 MEMORANDUM Order. Signed by the Honorable Milton I. Shadur on 4/6/2017:Mailed notice(clw, ) |
Filing 7 MEMORANDUM Order Signed by the Honorable Milton I. Shadur on 3/6/2017. Mailed notice (eaa, ) |
Filing 5 MEMORANDUM Opinion and Order: For the reasons stated in this opinion, plaintiff is to provide this Court with copies of his grievance, his appeal and the responses he received to both. Any failure to do so on or before March 24, 2017 will result in the dismissal of this action. Signed by the Honorable Milton I. Shadur on 3/2/2017:Mailed notice(clw, ) |
