Filing 11 MINUTE entry before the Honorable Edmond E. Chang: The Court has reviewed the complaint, R. 1, and issues the following jurisdictional inquiry. The Plaintiff relies on diversity jurisdiction under the Class Action Fairness Act of 2005, see 28 U.S.C. 1332(d), for subject matter jurisdiction. R. 1, para. 21. The Plaintiff alleges that he is "a resident of Vancouver, Washington." Id. para. 9. Although the Plaintiff later states in the complaint that he is "a citizen of a different state than Defendant," id. para. 21, the reference of residency causes ambiguity because the Plaintiff has not alleged that he is domiciled in Washington. For diversity jurisdiction, the citizenship of partiesas distinct from residencyis what matters. Heinen v. Northrop Grumman Corp., 671 F.3d 669, 670 (7th Cir. 2012) (diversity citizenship depends on State of domicile, not residency); Hunter v. Amin, 583 F.3d 486, 491 (7th Cir. 2009). Although jurisdiction is almost surely secure given that CAFA requires only minimal diversity, it is still better to confirm.
