Johnston: Federal courts are of limited jurisdiction, and a district court has a continuing obligation to ensure that it has jurisdiction over the cases before it. See Hertz Corp. v. Friend, 559 U.S. 77, 94 (2010). Although the defendant's notice of removal alleges federal question jurisdiction, it is premised on its own alleged violation of federal regulations, and it is not clear from the filings to date the basis of standing upon which the plaintiff may proceed on a private cause of action against the defendant for its alleged violation of federal regulations. This case may proceed for now, but the Court alerts the parties to these issues and that the Court must address them, even sua sponte, if at any time during the litigation it appears that standing and/or jurisdiction are lacking.
