April 18, 2013 Opinion or Order Filing 68 ORDER ADOPTING; The Court ADOPTS in its entirety Judge Williams' Report and Recommendation (Doc. 66 ), and DENIES in part and GRANTS in part Defendants' summary judgment motion (Doc. 60 ). The motion is granted as to the retaliation clai ms against Defendant Schwartz and Defendant Allen. No further claims remain against Defendant Schwartz. The motion is denied as to the deliberate indifference claim against Defendant Allen. July 14, 2011 Opinion or Order Filing 17 ORDER REFERRING CASE to Magistrate Judge Stephen C. Williams. The Clerk of Court is DIRECTED to complete, on Plaintiffs behalf, a summons for Defendants SWARTZ and ALLEN. The Clerk shall forward the summonses and sufficient copies of the complaint a nd this Memorandum and Order to Plaintiff so that he may serve Defendants. If Plaintiff desires to request the appointment of the United States Marshal to serve process on the Defendants, Plaintiff shall file a motion for service of process at govern ment expense, within 45 days of the date of entry of this order (on or before August 29, 2011). The Clerk of Court is DIRECTED to mail to Plaintiff the Courts Pro Se Litigant Guide, containing forms and instructions for filing said motion. IT IS FUR THER ORDERED that on or before August 29, 2011, Plaintiff may file a motion to voluntarily dismiss Counts 3, 4, 5, 6, and Count 7 from this action. IT IS FURTHER ORDERED that if Plaintiff does not voluntarily dismiss these Counts from this action, t he Court will sever these claims into a new action.
