ORDER granting in part and denying in part 6 Motion for Summary Judgment brought by Defendants Illinois Department of Transportation and Jim Layden. Count II and Count III of the complaint of Plaintiff Petroff Trucking Company, Inc. ("Petroff "), are DISMISSED with prejudice. The Court declines to exercise supplemental jurisdiction over Count I of Petroff's complaint, and Count I is REMANDED to the Circuit Court of the Third Judicial Circuit, Madison County, Illinois, for all further proceedings.
