Accordingly, the Court's Order dated October 22, 2013, dismissing the action (Doc. 8 ), the judgment (Doc. 9 ) and the O rder directing payment of the $400 filing fee (Doc. 11 ) are VACATED. Pursuant to Federal Rule of Civil Procedure 41(a)(2), this action is DISMISSED without prejudice. The Clerk of Court shall CLOSE THIS CASE; no judgment is required.
