COUNTS 1 and 2 are DISMISSED without prejudice for failure to state a claim upon which relief may be granted. Defendants BER GMANN, STRUBHART, and MIDDENDORFF are DISMISSED from this action with prejudice. Defendants KLOECKNER, HUDSPETH, and the UNKNOWN PARTIES (LDS, MP, and AMS) are DISMISSED from this action without prejudice. IT IS FURTHER ORDERED that, should he wish to proceed with COUNT 3 in this case, Plaintiff shall file his First Amended Complaint within 35 days of the entry of this order.
