Filing 105 ORDER: The Court GRANTS in part and DENIES in part the 74 Motion for Summary Judgment filed by Defendants Butler, Harris, and Monje. The Court denies the motion as to the claims against Defendant Harris in Counts 3 and 5 and grants the motion as to the claims against Defendant Butler and Defendant Monje in Count 4. Count 4 is DISMISSED without prejudice to refiling in the Illinois Court of Claims. Thus, Defendant Butler and Defendant Monje are DISMISSED without prejudice and the Clerk of Court is DIRECTED to TERMINATE these individuals as parties to this case. In addition, the Court GRANTS the 101 Motion for Summary Judgment filed by Defendant Lang. Count 6 is DISMISSED with prejudice. The Clerk shall TERMINATE Defendant Lang as a party to the case and enter judgment in her favor at the conclusion of the entire action. Magistrate Judge Sison is DIRECTED to recruit counsel to represent Moore at trial. Once counsel is recruited and enters an appearance, the undersigned will set this matter for a status conference to select firm dates for a final pretrial conference and jury trial.
