Simpson, III on 8/21/2015: The Court will grant the Commissioners motion to dismiss for lack of subject matter jurisdiction 19 , and Plaintiffs claims against the Commissioner will be dismissed wit hout prejudice. The Court will also deny Plaintiffs' motion for a hearing 29 . Plaintiffs remaining claims will be remanded to Jefferson County Circuit Court.
