MEMORANDUM OPINION & ORDER by Chief Judge Joseph H. McKinley, Jr on 12/24/2014: The motion for voluntary dismissal 6 is GRANTED. The 8/26/2014, Order granting Plaintiffs application to proceed without prepayment of fees and directing him to pay the $350.00 filing fee in installments DN 5 is VACATED. The Clerk of Court is DIRECTED to refund to Plaintiff any monies he paid toward payment of the $350.00 filing fee in this case. The Eastern Kentucky Correctional Complex shall cease collections from Plaintiffs inmate trust account for payment of the filing fee in this action.
