ORDERED that defendants' 22 Motion to Dismiss for Failure to State a Claim is GRANTED and that plaintiff's claims against Kim Warner and Gina Zulli in their indi vidual capacities for monetary damages are DISMISSED WITH PREJUDICE. FURTHER ORDERED that plaintiff's claims against Kim Warner and Gina Zulli in their official capacities for monetary damages are DISMISSED WITH PREJUDICE as set forth in document.
