Filing 35 RULING denying the 20 Motion for Partial Summary Judgment filed by plaintiff PCE Constructors, Inc. The motion is granted to the extent the cou rt finds that (1) the contract consists of the Proposal, the Pipe Fabrication Pre-Award Meeting notes, and the Purchase Order, and (2) the liability of Bristol Metals is limited to the remedies in paragraphs 12 and 13 of the Proposal.
