RULING: The 5 Motion to Dismiss is Granted in Part and Denied in Part. The Motion is GRANTED on Eleventh Amendment immunity grounds as to Plaintiff Kevin Bonin's 42 U.S.C. § 1983 and state law claims against Defendant Dr. Mary L. Livers in her official capacity. These claims are hereby dismissed without prejudice. The Motion is hereby GRANTED on Qualified Immunity grounds as to Plaintiff's 42 U.S.C. § 1983 claims against Defendant Dr. Mary L.
