The claims of Plaintiffs Rowan Court Subdivision 2013 Limit ed Partnership (Rowan) and John Does 1-60 against the Federal Defendants are DISMISSED WITHOUT PREJUDICE as barred by sovereign immunity. In the alternative, Plaintiffs claims are DISMISSED WITH PREJUDICE for failure to state a claim on which relief can be granted. Failure to do so will result in the dismissal of these claims with prejudice; IT IS FURTHER ORDERED that the State Defendants' Motion to Dismiss for Failure to Join a Party required under Rule 19 is DENIED WITHOUT PREJUDICE; IT IS FURTHER ORDERED that, in all other respects, the State Defendants' motion is DENIED.
