Filing 37 MEMORANDUM RULING - The crux of the matter on appeal 34 APPEAL OF MAGISTRATE JUDGE DECISION to District Judge filed by Rental Car Finance Corp, York Risk Services Group Inc. is whether the removal of the instant lawsuit to this Court was timel y. For the following reasons, this Court AFFIRMS the result and rationale reached by the magistrate judge, and this matter is REMANDED to the 15th JDC for the Parish of Acadia, Louisiana. Therefore, after review of the record, the arguments of the p arties, and the existing jurisprudence, this Court concludes that the decision of the magistrate judge was not clearly erroneous, and the result and rationale of the magistrate judge in his Ruling on Motion 32 is AFFIRMED. Therefore, the plaintiff's Motion to Remand 11 is GRANTED, and this action is REMANDED to the 15th JDC for the Parish of Acadia, Louisiana. Signed by Judge Rebecca F Doherty on 11/04/13.
