Minute Entry for virtual proceedings before Magistrate Judge David R. Grand: Motion Hearing held on 3/8/2022 re #1 MOTION to Quash Subpoena duces tecum filed by Susanne Iacobelli Disposition: On March 8, 2022, the Court held oral argument on Susanne Iacobelli's Motion to Quash Subpoena Duces Tecum. (ECF No. 1). The Court explained in detail its conclusion that the "spousal privilege" codified in M.C.L. 600.2162(1) applied to questions to be put to Ms. Iacobelli that would constitute testimony "for or against" her husband, notwithstanding that he is not a party in the underlying action. The Court also explained, however, its unwillingness to prospectively disallow any and all questioning of Ms. Iacobelli. It was agreed that the parties would meet and confer in good faith to determine whether, in light of the Court's rulings, disputes remain about the specific questions, if any, that can be asked as Ms. Iacobelli, and if so, to determine a schedule for submitting supplemental briefs on those issues. Accordingly, unless the parties submit a stipulated order on those issues by April 18, 2022, the Court will hold a telephonic status conference with counsel on April 21, 2022, at 1:00 p.m. (Court Reporter: Shacara Mapp) (EBut)
