Filing 18 ORDER OF DISMISSAL: For the reasons set out in the Order, any habeas claims Plaintiff is asserting in this complaint are dismissed without prejudice so that those claims may be pursued in his pending Petition for habeas relief in Smith, No. 3 :15cv354-DPJ-FKB. The claims filed pursuant to § 1983 are dismissed with prejudice as frivolous and for Plaintiff's failure to state a claim against the named Defendants.
