ORDER denying 32 Motion to Dismiss for Failure to State a Claim; denying 32 Motion to Dismiss for Lack of Jurisdiction EXCEPT as to claims relating to Eaton's breach of the Non-Disclosure Agreement, breach o f the Separation Agreement after July 15, 2010, or Taylor Brands' interference with those contracts. With respect to Eaton, all that remains of Counts Four and Five are claims relating to the breach of the Separation Agreement occurring before i ts expiration date. Granting in part and denying in part 16 Motion for Preliminary Injunction. GRANTED IN PART Taylor Brands is enjoined from further infringing Montana Silversmiths copyright in the Bull Rider Belt Buckle and from further making, selling, or distributing any of its Bull Rider Belt Buckles. Montana Silversmiths shall provide a 25,000 dollar security bond pursuant to Rule 65(c) within 7 days of the entry of this Preliminary Injunction.
