OPINION AND ORDER: IT IS HEREBY ORDERED that Defendants' Motion for SummaryJudgment (Doc. 15) is GRANTED as to Counts I and II and DENIED as to Counts Ill, IV, and V of the First Amended Complaint. The Court confirms the trial date of Septembe r 11, 2018, for trial of Plaintiffs remaining state law claims. The remaining deadlines set in the Court's Preliminary Scheduling Order (Doc. 12) remain in full force and effect. IT IS FURTHER ORDERED that this matter is referred to United S tates Magistrate Judge John Johnston for the purpose of conducting a settlement conference, which will be set down by him by subsequent order.
