ORDER that 1 Motion/Application for Leave to Proceed in forma pauperis is GRANTED. The Clerk shall SEND a copy of this order to the Finance Division of the Clerk's Office. The Clerk shall also SEND a copy of this order addressed to the Chief of Inmate Services for the Nevada Department of Corrections. FURTHER ORDERED that this action shall be DISMISSED without prejudice for failure to state a claim upon which relief may be granted. This dismissal shall count as a"strike" for purposes of 28 U.S.C. § 1915(g). The Clerk shall enter final judgment accordingly, dismissing this action without prejudice. Signed by Judge Andrew P.
