February 15, 2006 Opinion or Order Filing 20 ORDER GRANTING 103 Motion for Partial Summary Judgment ---- For the reasons set forth in the ATTACHED WRITTEN SUMMARY ORDER, Domino's Pizza, Inc.'s motion for summary judgment as to the claims contained in Docket # 02-cv-3898 is GRANTED. Domino's Pizza, Inc.'s motions for attorney's fees and costs as to both Dockets # 02-cv-3898 and 02-cv-5028, which were previously consolidated, are also GRANTED, and the calculation of reasonable attorney's fees and costs is ref erred to Magistrate Judge Viktor V. Pohorelsky. It is further hereby ORDERED that: 1 Dockets # 02-cv-3898 and 02-cv-5028 are no longer consolidated; 2 the Clerk of the Court is directed to close the files maintained under Docket # 02-cv-3898, an d forward it for judgment; and 3 the Clerk of the Court is directed to reopen Docket #02-cv-5028, and that matter is referred to Magistrate Judge Pohorelsky for further proceedings on the claims that remain.
