April 17, 2009 Opinion or Order ORDER OF DISMISSAL - By Order dated March 14, 2009, the court granted pro se plaintiff leave to file an amended complaint on or before April 14, 2009. Plaintiff was admonished that failure to file the amended complaint on or before said date would result in automatic dismissal of this case. To date, plaintiff has failed to file the amended complaint. Accordingly, this action is DISMISSED without prejudice. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. March 14, 2009 Opinion or Order Filing 5 ORDER denying 3 Motion to Appoint Counsel ; granting 2 Motion for Leave to Proceed in forma pauperis -- For the reasons set forth in the ATTACHED WRITTEN SUMMARY ORDER, pro se plaintiff's application for appointment of pro bono counsel is DENIED. In an abundance of caution, however, and in deference to plaintiffs pro se status, the court grants plaintiff thirty (30) days to amend his complaint. The amended complaint must be captioned as an "Amended Complaint" and bear the same docket number as this Order. For the convenience of pro se plaintiff, the court has attached Instructions on How to File an Amended Complaint. No summonses shall issue at this time and all further proceedings shall be stayed for thirty (30) days. If plaintiff fails to amend his complaint within thirty (30) days of the entry of this Order, i.e., by April 14, 2009, the court will dismiss this complaint. The court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. The Clerk of the Court is directed to mail a copy of this Electronic Order, the Attached Summary Order, and Instructions on How to File an Amended Complaint to pro se plaintiff.
