MEMORANDUM AND ORDER granting 58 Motion to Dismiss; terminating 66 Motion to Adjourn Conference: For the reasons stated in the attached Memorandum and Order, plaintiffs motions to strike the third-party complaint and dismiss all claims against Breaking (Doc. No. 58) are GRANTED; Citys third-party complaint (Doc. No. 33) is DISMISSED in its entirety; and plaintiffs fourth, fifth, sixth, and seventh causes of action (Compl. (Doc. No. 1) 2742) are DISMISSED in their entirety. Citys crosscl aims against Breaking, and Breakings crossclaims against City are DISMISSED by stipulation (Doc. No. 57). In light of this Memorandum and Order, plaintiffs shall advise whether a conference with the Court is necessary at this time, and if so, the issues plaintiff intends to raise at any such conference.
