Accordingly, for the reasons set forth in Magistrate Judge Reyes' August 17, 2012 Report and Recommendation 33 , the court grants plaintiff's motion for default judgment and orders that judgment be entered in favor of plaintiff in the amount of $734,563.48, with an additional $131 .13 per day accruing from the date of the Report and Recommendation, August 17, 2012, through the entry of final judgment. September 27, 2012 Opinion or Order Filing 41 ORDER ADOPTING REPORT AND RECOMMENDATION. For the reasons set forth in the attached decision and in Magistrate Judge Reyes' thorough and well-reasoned Report and Recommendation, the court adopts the R&R and grants plaintiff's motion for de fault judgment without prejudice to defendant's right to contest service, which is the sole remaining issue in this case. Defendant is granted until October 30, 2012 to obtain counsel and submit a sworn or affirmed denial of receipt of service that swears or affirms under penalty of perjury to specific facts to rebut the statements in Mr. Browne's affidavit. Upon receiving defendant's sworn or affirmed factual submission, the court will determine whether a traverse hearing is req uired and schedule a hearing, if necessary. If the court does not receive any sworn or affirmed submission from the defendant by October 30, 2012, the court will direct the Clerk of Court to enter judgment in favor of plaintiff and against defendant in the amount of $734,563.48, with an additional $131.13 per day accruing from the date of the R&R, August 17, 2012, through the entry of final judgment, plus post-judgment interest to the extent provided by law. Plaintiff shall serve a copy of this decision on the pro se defendant via overnight mail and file a certificate of service via ECF by September 28, 2012. Ordered by Judge Kiyo A.
