May 15, 2012 Opinion or Order Filing 148 MEMORANDUM & ORDER granting 137 Motion for Summary Judgment. For the reasons set forth in the attached Memorandum and Order, SEC's motion for summary judgment on its first through fifth counterclaims is granted. FKC, Jane Solomon, and Robert Solomon are jointly and severally liable to SEC for the Arbitration Judgment in the amount of $545,147.58 plus interest at a rate of nine percent per annum from November 13, 2009 until the date of entry of judgment in this case, with interest a t the federal post-judgment rate thereafter. In addition, SEC will be entitled to recover from the FKC Plaintiffs its reasonable attorneys' fees for prosecuting its first counterclaim, upon an application properly supported by contemporaneous time records and filed no later than May 29, 2012. March 28, 2012 Opinion or Order Filing 144 ORDER granting 100 Motion to Dismiss. For the reasons set forth in the attached Memorandum and Order, defendant's motion to dismiss plaintiffs' Complaint is granted. Accordingly, plaintiffs' first, second, and third causes of actio n, as well as defendant's sixth, seventh, eighth, and ninth counterclaims, are dismissed. Having determined that defendant's remaining counterclaims relate to a separate arbitration judgment and there is no just reason for delay, the court respectfully requests the Clerk of the Court to enter judgment dismissing plaintiffs' first, second, and third causes of action, and defendant's sixth, seventh, eighth, and ninth counterclaims. See Fed. R. Civ. P. 54(b). By April 30, 201 2, the parties shall jointly seek clarification from the Queens County Supreme Court as to whether the funds presently in the registry of the Clerk of this court are subject to the Queens court's injunction, shall jointly report back to this court as to whether or not the funds should be transferred to the Queens County Clerk, and shall submit copies of any orders by the Queens court on this issue.
