Filing 22 ORDER granting 19 Motion to Dismiss for Lack of Jurisdiction: For the reasons stated in the attached Memorandum and Order, the FDIC's motion to intervene and dismiss (Doc. No. 19) is GRANTED. Defendant Nell's counterclaims two, four, fi ve, six, and seven are dismissed, Chase's third-party complaint against the FDIC is also dismissed, and the remaining claims are remanded to Supreme Court of the State of New York, County of Richmond.
