MEMORANDUM AND OPINION, As there is no ongoing case or controversy, the petition is denied as moot. Because petitioner has failed to make a "substantial showing of the denial of a constitutional right," 28 USC sec. 2253(c)(2), the court dec lines to issue a Certificate of Appealability.
