Accordingly, the Court dismisses the complaint, filed in forma pauperis, against defts for lack of subject matter ju risdiction. The Court also denies Smith's request for an order to show cause. Any state law claims are dismissed without prejudice. The Court certifies pursuant to 28 USC sec. 1915(a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal.
