His motion is ostensibly made pursuant to Rules 59 or 60 of the Fed. R. Civ. P. The motion he made to unseal the docket in 98 CR 1101 was granted. Palmer's letter motion concludes with "In the interest of simplicity, this small enlargement is requested so that this may be dealt with without the complex formality of an appeal." He may choose to take note of Judge Posner's observation in Sullivan, supra: That "an appeal from a denial of such a motion is frivolous." His attorney should also be aware that by presenting a motion or other paper to the Court he "certifies" that "the claims and other legal contentions are warranted by existing law or by nonfriviolous argument and are not being presented for any improper purposes."
