Filing 16 MEMORANDUM & ORDER denying 15 Motion for Default Judgment and dismissing 1 Complaint. For the reasons set forth herein, plaintiff's federal cause of action is patently meritless, and the amount in controversy in this case never reached $ ;75,000.00, which divests this Court of jurisdiction over his remaining state and common law claims. His motion is therefore DENIED and his Complaint DISMISSED without prejudice to the refiling of the claims over which this Court lacks jurisdiction in state court.
