October 15, 2014 Opinion or Order Filing 6 DECISION AND ORDER: The Court grants Petitioner's 2 motion to proceed in forma pauperis solely for the purpose of this Order. The 1 Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254 is DENIED. Furthermore, Peti tioner's 5 Emergency Motion for Judgment on the Pleadings pursuant to Fed. R. Civ. P. 12(c) is also DENIED. A Certificate of Appealability shall not issue because Petitioner has not made a substantial showing of the denial of a constitutiona l right. The Court certifies that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. The Clerk of Court is directed to enter judgment accordingly and close the case. The Clerk of Court shall also provide Petitioner with notice and a copy of this Order. SO ORDERED by Judge William F.
