For the reasons provided in the annexed order, the court respectfully overrules plaintiff's objections and adopts Judge Orenstein's Report and Recommendation as it pertains to liability. Because the court finds that plaintiff cannot establish liability against defendant under any of its claims, the court does not reach plaintiff's argument regarding relief. Plaintiff's motion for default judgment is DENIED. The Clerk of Court is respectfully directed to enter judgment against plaintiff and close this case. Ordered by Judge Kiyo A.
