ORDER ADOPTING REPORT AND RECOMMENDATIONS AND REMANDING CASE TO NEW YORK STATE SUPREME COURT, KINGS COUNTY -- For the reasons set forth in the ATTACHED WRITTEN MEMORANDUM AND ORDER, defendant's objections to the Report and Recommendations issued by the Honorable Marilyn D. Go, U.S.M.J. are overruled in their entirety and the Report and Recommendations are adopted in their entirety. Accordingly, Plaintiffs' motion to amend the complaint and remand this matter to state court is granted and this action hereby is REMANDED to the Kings County Supreme Court, under Index No. 13175/2014, for lack of federal subject matter jurisdiction.
