Filing 86 MEMORANDUM AND ORDER. For the reasons stated herein, plaintiff's 48 motion for summary judgment is denied. Defendants' 67 motion for summary judgment is granted only with respect to the claim of false entry into the common hallwa y; the motion is otherwise denied. The complaint is deemed amended to include a claim for false entry into the kitchen, which is considered denied by defendants and may go forward. Defendant William Chien is dismissed on qualified immunity grou nds. Defendant Nicholas Morin is dismissed on consent.A jury will be selected by the magistrate judge on July 11, 2016. Motions in limine will be heard at 11:30 AM on July 20, 2016 in Courtroom 10B. Trial will begin at 12:30 PM on the same day. Ordered by Judge Jack B. Weinstein on 6/27/2016. (Barrett, C) |
