Filing 5 MEMORANDUM AND ORDER: Plaintiff's 2 request to proceed in forma pauperis is granted for the limited purpose of this order, and the action is dismissed as frivolous and for failure to state a claim pursuant to 28 U.S.C. § 1 915(e)(2)(B), and for lack of subject matter jurisdiction pursuant to Fed. R. Civ. P. 12(h)(3). Plaintiff is warned that the future filing of frequent frivolous lawsuits may result in the imposition of sanctions, including the issuance of a filing injunction. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauper is status is denied for purpose of an appeal.
