MEMORANDUM OF DECISION AND ORDER - It is hereby: ORDERED, that the plaintiff shall serve and file a satisfaction of the judgment, in the terms directed by the Court, which satisfaction shall state that it is subject to the plaintiffs appeal on the is sues of payment of the Marshals fee and the amount of pre-judgment interest, together with a release of the defendants Supersedeas Bond, within five (5) days of the date of this Order; and it is further ORDERED, that the plaintiffs attached Supersede as Bond is approved for the purpose of staying the effect of the Courts prior Orders only with regard to the two issues of (1) who shall pay the Marshals fee, and (2) the amount of post-judgment interest. MEMORANDUM OF DECISION AND ORDER - (1) The Court finds that the plaintiff has established his breach of contract cause of action and awards him damages on that cause of action as follows: Loss of Salary $489,616.14; Medical Insurance Premiums &# 036;39,425.33; Dental Insurance Premiums $3,545.59; Total Damages $532,587.06. With prejudgment interest at 5% from February 1, 2008. (2) The Court finds that the plaintiff failed to establish his tortious interference cause of action against the defendant David Palcek and that cause is dismissed. (3) The Clerk of the Court is directed to enter judgment in favor of the plaintiff Robert N. Cappiello against ICD Publications Inc. in the total amount of $532,587.06 with prejudgm ent interest at the rate of 5% from February 1, 2008. (4) The Clerk of the Court is directed to enter judgment on the tortious interference with contract cause of action in favor of the defendant David Palcek, dismissing that cause.
