For the reasons set forth in the attached Memorandum and Order, IT IS HEREBY ORDERED that Court grants defendants' motion to dismiss plaintiff's § 1983 claims on qualified immunity grounds for alleged unconstitu tional conduct in connection with his arrest and incarceration for a PRS violation on April 2, 2008 and his continued incarceration until September 2008. The Court, in its discretion, declines to exercise supplemental jurisdiction over any state law claims. The Clerk of the Court shall close the case and enter judgment accordingly. SO ORDERED. March 31, 2010	Filing 14 ORDER granting in part and deferring ruling in part 6 Motion to Dismiss. For the reasons contained herein, the Court grants defendants motion to dismiss plaintiffs § 1983 claims on qualified immunity grounds for alleged unconstitutional condu ct in connection with his arrest and incarceration for a PRS violation in 2007 prior to the decisions in Sparber and Garner. With respect to the § 1983 claim arising from plaintiffs arrest and incarceration in 2008, the Court requests additiona l briefing on the qualified immunity issue. A telephone conference will take place on April 20, 2010, at 11:00 a.m. to discuss the timing and scope of the supplemental briefing. SO ORDERED. Ordered by Judge Joseph F. Bianco on 3/31/2010.
