First, the motion to dismiss the claims against the Nassau County Police Dept is granted, but the claims are deemed to be asserted against the County of Nassau. Second, the motion to dismiss the claims against the County of Nassau is granted, but plaintiff is granted leave to amend her pleadings to correct the defects discussed above. Third, the motion to dismiss any Section 1985 claim against the Nassau County defts is granted. Finally, the motion to dismiss the other claims against deft McMullen is denied. If plaintiff wishes, she may file an amended complaint, within 45 days of this Memorandum and Order, attempting to re-assert a Monell claim against the County of Nassau and a Section 1985 claim against deft McMullen. Specifically, plaintiff is fully capable of responding to the motion to dismiss by the Nassau County defts and, in fact, has submitted an affirmation in opposition to the motion. There is nothing complex about the factual allegations or the legal issues surrounding this litigation. Moreover, having considered the other reasons referenced in the renewed request for counsel, plaintiff has failed to identify a sufficient basis for appointment of counsel at this juncture.
