Filing 98 ORDER granting in part and denying in part 89 Motion for Reconsideration. For the reasons set forth above, Plaintiff's motion for reconsideration is GRANTED and the Court amends the September 28, 2012 Order as follows: (1) Plaintiff's mo tion for summary judgment for claims brought pursuant to 15 U.S.C. §§ 1692e(4) and e(5) is GRANTED; (2) The negligent hiring, retention, training and supervision claims are deemed moot and thus reconsideration is not necessary; and (3) Sect ion III(C) of the September 28, 2012 Order discussing and ruling on the claim for intentional infliction of emotional distress is stricken.
