MEMORANDUM AND ORDER denying as moot 38 Motion to Amend/Correct /Supplement; granting 20 Motion to Dismiss. For the foregoing reasons, Defendants' motion to dismiss is GRANTED and Plaintiff's Amended Complaint is dismissed. Plainti ff may file s Second Amended Complaint within thirty (30) days from the date of this Order. Plaintiff's January 5, 2012 letter motion to amend is moot in light of the Court's decision granting leave to amend.
