For the reasons set forth in the attached Memorandum and Order, the portion of the motion seeking to compel production of documents held by non-party iTV Beijing is GRANTED as to all Defendants, but Plaintiff's request for sanctions pursuant to Fed. R. Civ. P. 37 is DENIED. On or before March 17, 2017, Defendants shall produce the relevant documents in the possession of iTV Beijing. The motion to dismiss by Lin and the iTV Group is granted with respect to the negligent misrepresentation and intentional infliction of emotional distress claims, and the claim for punitive damages, and is otherwise denied. Plaintiff is granted leave to amend the complaint with respect to the intentional infliction of emotional distress count and/or a claim for punitive damages, and shall file the amended complaint no later than thirty days after the date of this order.
