Filing 37 MEMORANDUM OF DECISION AND ORDER - For the foregoing reasons, the Court (1) grants the Plaintiffs motion to amend the complaint; (2) treats the pending motions to dismiss the complaint for failure to state a cause of action as directed at the amended complaint; and (3) grants the motions to dismiss. The amended complaint is dismissed. The Plaintiffs state law claims, in particular, are dismissed without prejudice to being refiled in state court. See Mathie v. Womack, No. 14-CV-6577 (JS) (GRB), 2 015 WL 419802, at *3 (E.D.N.Y. Jan. 29, 2015)(declining, after dismissing lone federal claim, to exercise supplemental jurisdiction over state law claims and dismissing those claims without prejudice to being refiled in state court.).
