MEMORANDUM & ORDER granting 12 Motion to Dismiss for Failure to State a Claim; granting 12 Motion to Dismiss for Lack of Jurisdiction; granting 15 Motion to Dismiss; For the foregoing reasons, both the motion of defendant Haber to dismis s the Complaint for lack of subject matter jurisdiction and failure to state a claim pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6) (Docket Entry 12) and the motion of the Supervisor Defendants to dismiss the Complaint for lack o f subject matter jurisdiction and for failure to state a claim pursuant to Federal Rules 12(b)(1) and 12(b)(6) (Docket Entry 15) are GRANTED. Plaintiff's Federal Claims are DISMISSED for lack of subject matter jurisdiction. Plaintiff's Stat e Claims are DISMISSED WITHOUT PREJUDICE to refiling in the appropriate court.
