MEMORANDUM & ORDER granting 8 Motion to Dismiss; granting 12 Motion to Dismiss; The SCWA Defendants' motion to dismiss the Complaint (Docket Entry 8) is GRANTED, and Plaintiff's claims against the SCWA Defendants are DISMISSED WITHO UT PREJUDICE and with leave to replead. The Union Defendants' motion to dismiss the Complaint (Docket Entry 12) is also GRANTED, and Plaintiff's claims against the Union Defendants are DISMISSED WITHOUT PREJUDICE and with leave to replead. If Plaintiff wishes to file an Amended Complaint, he must do so within thirty (30) days of the date of this Memorandum and Order. If he fails to do so, his claims will be dismissed with prejudice. Plaintiff must properly serve the Individual Defendan ts within twenty (20) days from the date of this Memorandum and Order. The Clerk of the Court is directed to amend the caption and replace Oscar Montavo with his correct name Oscar Montalvo, Donna Marcusso with her correct name Donna Mancuso, and Jane Maressi with her correct name Jane Morrisroe.
