Filing 9 MEMORANDUM & ORDER terminating 2 Motion for Leave to Proceed in forma pauperis; granting 6 Motion for Leave to Proceed in forma pauperis; For the reasons set forth above, Plaintiff's application to proceed in forma pauperis is GRANTED, ho wever the Complaint is sua sponte DISMISSED WITH PREJUDICE as against the Police Department for failure to state a claim pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii), 1915A(b)(1). Plaintiff's claims against Sgt. Conklin, Sgt. Burke, P. O. Psomas, P.O. Wolfer, and Det. Walsh shall proceed. The Court ORDERS service of the Summonses and Complaint and a copy of this Order upon these Defendants by the U.S. Marshal Service forthwith. The Court certifies pursuant to 28 U.S.C. § 1915( a)(3) that any appeal from this Order would not be taken in good faith and therefore in forma pauperis status is DENIED for the purpose of any appeal.
