Filing 36 ORDER granting 29 Motion to Dismiss for Failure to State a Claim. For the reasons stated herein, the Court grants defendants' motion to dismiss the RICO claim with prejudice. Given the dismissal of plaintiffs' federal claim, the Court declines, in its discretion, to exercise supplemental jurisdiction over plaintiffs' state law claim for fraudulent inducement and, thus, dismisses this claim without prejudice to re-filing in state court.
